This book is the first one to examine in detail the provisions of the so called `All Crimes’ Legislation which has been implemented in most offshore jurisdictions. The reference point is The Criminal Justice (Proceeds of Crime) (Bailiwick of Guernsey) Law 1999 which is very similar to the equivalent legislation in Jersey, the Isle of Man, England and the other major offshore centres, including the Carribean.
The book will be of use to practitioners in these jurisdictions and makes reference to the relevant case law in England and elsewhere where appropriate.
In recognition of the problems this legislation may give practitioners in relation to the notoriously wide "tipping off" provisions there is a special chapter dealing with constructive trusts and a discussion of the recent case in England of C v S.
