A Book on Jersey’s new
security law

The Security Interests (Jersey) Law 2012 (the “Law”) is a significant
reform of Jersey’s security law. The Law comes into full force on 2 January
2014. From this date, all new security over intangible property will need
to comply with the Law. The Law is influenced by the Personal Property
Security Acts of Canada and New Zealand. The book will comment in detail on the
provisions of the Law. The book will consider the nature of security
interests and will contain chapters considering the key concepts of the
attachment and perfection of security interests, the priority of security
interests, the enforcement of security interests and the registration of
security interests.    

About the author

Mark is a partner in the banking and corporate department of Bedell Cristin, a
leading offshore law firm. 
Mark has extensive experience in banking, structured finance and
corporate law matters.  
Mark’s banking experience includes property finance, project finance,
acquisition finance and syndicated lending. He also has extensive experience in
advising leading Jersey banks on a range of domestic transactions. Mark also
advises banks on enforcement options as regards defaulting loan transactions.

Before joining Bedell Cristin, Mark was a partner in the Banking and Projects
Group of Theodore Goddard in the City of London and (after its merger)
Addleshaw Goddard.

He is recognised as a leading practitioner by Chambers 2013, which acknowledges
that Mark is “very experienced in insolvency and restructuring issues, and shows particular finesse in the more complex structured areas involving property and tax
knowledge.” 
 

Mark is the Adjunct Professor at the Jersey Institute of Law for Company
Law and also for Security and Bankruptcy Law. 

Mark is a member of the Jersey banking lawyers working group which has
commented on the Security Interests (Jersey) Law 2012 through its various
drafts and legislative development. Mark has therefore been closely involved
with the development of the new security law from its inception.

Mark is the author of “Dunlop on Jersey Company Law” (published by Key Haven PublicationsLtd). This is the first comprehensive book to be published on Jersey company law. The book examines in detail the provisions of the Companies (Jersey) Law 1991 and the leading Jersey law cases on company law matters.
