Paul Baxendale Walker, author of the main authority on Employee Benefit Trusts Law and Taxation of Remuneration Trusts, analyses the scope of Part 7A ITEPA in relation to trust benefits to employees. He finds the earmarking provision to be ‘a matchstick tower of absurdities’ and notes that the objectives of the legilation could all have been achieved by a much simpler route.
